    Have you visited the offices of US Congressmen in DC, and tried to explain our issue to Senators and Congressmen? Yes, I have. I was asked the same question in each and every office - "If half-a-million people are impacted by the backlogs, how come only 3-4 people (idiots like me) visit us with this complaint. Why aren't we visited by our other constituents? Why don't your members even write letters to us?".

    This is THE REASON why the movement has not made much headway.

    It is always an option for any one with in their org, but if his point is wrong, then IV core leadership should prove him that they are not sitting idle or moving very very slow.

    Every one starting their own organization or asking to do so doesn't solve the purpose.

    Will this economy slow down and people returing back to there motherland have any effects on PD?

    How many of the returning people would call USCIS to cancel their 485s? I see almost zero.

    Hi Tina,

    Do you know any employer or recruiting agency (in NY) who can help sponsoring physical therapists for 140 & 485.

    I got a NY work permit and got my crdentials evaluated but unfortunately that emplyer is no longer having job vacancy. Now I am stuck and don't know if I can get benefit from some other employer.

    Any input would be greatly helpful.

    A lot of employers are willing to sponsor Schedule A applications, as far as you get your own lawyer & bare the costs, especially if they don't have an immigration department. So you may want to let them know that you have a lawyer who can file as soon as. Some employers already have the employment notice.

    I filed my papers around the same time. Do you want to keep in touch and see how things go?

    Pls lets all keep in touch. My lawyer sent mine around the same time as well. Did anyone have to file with a visascreen? One law firm said that the EAD would be denied becasue of no visascreen!!

    I changed them for another law firm. Any other lawyers saying the same regarding visascreen?

    Mass porting to EB2 category is the only option. I think most people with old EB3 PD can easily do it. I was reluctant initially but since there is no light at the end of the tunnel, why not take a chance while PD porting is still available. Dont get discouraged by people advising against it, since there is no hope for EB3 anyways.

    I see that we all are very busy fighting amongst ourselves. Did all of you get a chance to "Digg" the story so it gets maximum publicity possible? This is the only story so far that carefully analyzes the 485 fiasco and longer it runs the better it will be for us.

    The underwriters was OK with my H1B + I-140 Approval + I-485 Reciept.

    I think what AILA, our core group and other attorneys are trying to say is that as long as you filed before May 15, 2007 you will be fine regardless of whether your petition is pending or approved. There is no dispute about this point. Any applications that were filed after May 15, 2007 will become null and void the day this bill is signed by the president to make it a law. The 'effective date' ( Oct 1, 2008 ) does not apply for applications filed after May 15, 2007. I will be glad if you can prove me wrong :)

    He's been an advocate on backlog issues, and his staff had helped look into my case last year. I used his web site to send him an email (for VA residents only), slightly modifying the phone script to thank him, since I finally got my green card in November. Will post response when I receive it.

    Guys good news from my side. Just got most awaited Card production Ordered emails for my wife and my son. I have not received the email for myself though. When I checked the status on Case Status Online site, I found that 485 for all three of us have been approved.

    My priority date was Oct 2004 at NSC. Came to US in Feb 2000, so almost 8.5 years of waiting is finally finally over. I hope that NSC picks up the pace and approve all the people who are current.

    Trust me!! I am not going anywhere. I will enjoy my green but at the same time will always work relentlessly to get the immigration reforms. I also prey from God almighty that all my friends/family members stuck in EB2/EB3 will also get their GC ASAP.

    Wish you all the best, even though I have crossed the fence towards the greener pasture, I am always there to lend you a hand and help you climb up and jump across the fence.

    In continuation to my posting from the previous thread (http://immigrationvoice.org/forum/showthread.php?t=20598), I have made some changes to the draft letter based on the comments received from few members. Now I have two versions of the same letters, one for TSC petitioners and other for NSC petitioners. This letter addresses the delay in processing of I-140 petitions at TSC & NSC.
    Here are guidelines to mail this letter (pick the letter that corresponds the service center where your I-140 is pending):

    1. Please review the corrected draft letters and post any constructive comments on this thread to make it more effective. You can do so until 08/07/2008 (August 7th 2008)
    2. Based on the comments and suggestions received, I'll post the final version of the letter to be mailed on this thread on 08/08/2008 (August 8th 2008)
    3. Members can then copy/paste the letter onto a word document and then along with completed DHS Form 7001, mail the documents to USCIS Ombudsman's office early next week(08/11/2008 through 08/15/2008). Please note that this form needs to get your employers signature ( or whoever is the petitioner) as we are checking on an I-140 petition.
    4. You can find DHS Form 7001 at http://www.dhs.gov/ximgtn/programs/editorial_0497.shtm
    5. Please make sure, you provide complete and correct information on this form to be mailed to Ombudsman's office. All forms with incomplete and fake names will be ignored by the Ombudsman's office. So please provide the correct information to the Ombudsman's office for them to investigate this issue.
    6. Once all the forms and letters reaches the USCIS Ombudsman's office they will need atleast 4 weeks to look into this problem and send you a response. They are obligated to send you a response, since you sent them a completed Form 7001 inquiring about your case.
    7. Please post the responses you receive from Ombudsman's office on this thread. Based on the responses we receive, we can compile the responses and then take the next course of action with IV core's guidance.

    Please feel free to post any questions or clarifications you need before mailing this letter.

    Don't we need the consent of the petitioner (employer)? Please see the line item # 15.

    A cut-off date avoids submission of AOS applications with PD after cut-off date. In my opinion, this was the only reason to retrogress on July 2: avoid AOS submission whose PDs became current in July.

    Now nearly all AOS applications have been submitted. Hence, setting cut-off dates conservatively is not that motivating.

    If let us say 20,000 visas were unallocated in 2007 and USCIS realized that on the 28th of September, 2007, they still wont be able to use up those 20,000 visas. Because the priority dates were pushed back so far that there probably isn't that many applications that have completed the fingerprinting and name check stage. So, we have another reason to believe that USCIS may not be able to use up all the visa numbers just because of the priority dates (even if they worked throughout the weekend).

    So it makes sense "now" to put the cut off dates a little conservatively because USCIS has already received those applications. They should be allowed to approve them according to the visa number availability and the case status in a first come first serve basis (considering the receipt and priority dates).

    So # legal immigrants/year = 480K (FS) + 140K (EB) + 50K (diversity) + Refugee + Asylum + ... = 670K + ... ~= 1M (reported in articles)
