I just missed 120-90 day window for filing EAD. My EAD expires on oct 12 and today is July 12TH.
Other stats:
Have H1B active with current employer till Feb 2009
Just got my priority date current - EB2 July 2004 for India
I-140 approved, I-485 and I-140 filed last year receipt date Sept 2007
Questions:
How can I get new EAd now?
I can continune working on H1B correct?
Any impact on my 485 application that now will process due to PD being current?
PLEASE HELP. I am confused and worried a bit.

started as an intern with local in the month of march 06 and I was given offer till end of august. but my school official gave me work permit on a semester basis and gave it only for srping 06, which end in may 15th. I couldn't update my CPT status for 1 day for summer 06 and started on 16th may, so the school official has said that i am out of status.Since re-instatement is not possible from school as it was unauthorized work permit. They have advised me to go to home country and attend visa to be eligible for reinstatement. I have grauduated last month with masters of science..
They said they will provide me recommendation letter for me to show to consular officer. Also, I have an MBA admit in same university for spring 2007.
so should i come to new program..if thats the case how to get an emergency appoitment.

There is no mandate about that....They can come back anytime before Aug 17 as long as their PD is on or before July 31st, 2007.....Since USCIS said it will not reject 485s without medicals, you can get the medicals done later and submit when they send you an RFE....However, make sure to keep all the applications filled in and ready for mailing except for the signatures and I-94 information of the returning individuals......

My EAD was about to expire in 4 months. I'm going to apply for the renewal. Can I keep working if the application is pending?
You can work as long as the EAD is valid. If you meant to ask if you can legally work while your old EAD has expired and your new EAD is pending, the answer is NO.
One more thing, the USCIS is required by law to make decision on your EAD application withing 90 days upon receiving your application. But someone didn't get that within 90 days. That casused problem bacause you can only apply for renewal of your EAD if it is 90 days or less before your old EAD will expire.

When an h1b transfer via regualr processing (california center) is pending...and say the person gets fired /layed off etc....
Can another h1b transfer be done with just the recepit notice and previous I-797?
What's the risk? Some companies are not willing to do premium processing even if the candidate is ready to pay the premium process fee.

B1 is purely-non-immigrant-intent visa while H1 is dual-intent. Given this, I do not see any harm entering on B1 while you have a valid I-797 presumably starting Oct 1st? So, after returning you can appear for H1 visa stamp and later enter using H1.

I have a question regarding dependants. I have a L1A Visa. I am going on a long trip to UK next month. Can my dependants stay back for 2 -3 months before joining me in UK. Their L 2 Visa and I 94 are valid till Feb 2009.
