IV Team,
I have been calling the list of Senators - and some of them say they do not support amnesty. I do talk about high skilled immigrants (from pappu's brief). My question is how do I make the distinction between the two groups without sounding that I am being against the undocumented?

Why this fight for EB2 vs EB3..
ideally GC should be given based on one's arrival in US or based on first filing of GC..irrespective of which category u r
keeping that in mind, it doesn't matter, if u r EB2 or EB3 or if u r porting the date..because in either way..one will get GC (luck is still a factor) based on number of years in US or years since GC process started.
given a chance and if permissible under the law, most of us would want to switch to EB1..or even change the birthplace..to avoid this mess..but then it is too difficult to switch to EB1 compared to switching from EB3 to EB2. one would always take the least resistive path and it is right as long as it is not illegal under the current law..(oh..no..don't talk about morality..because when personal interests are at stake..nothing matters..for most of us)
anyway..they have successfully created enough divisions among ourselves EB1,2,3...row...the bright side of eb3 to eb3 porting is..that everyone will become eb2 and then we will stand united..hopefully..but then we will have divisions..eb2 before this year..eb2 originally filed..eb2 with masters from us..eb2 with 5 yrs of experience..eb2 with two masters...eb2 with fair screen..eb2 with black skin..

Didn't realise they now have a PERM backlog center. I thought baclkog centers were only for traditional and RIR labours, I guess there is no end to the circus of immigration life.
officially no PERM backlog center exist....but the way Atlanta is processing cases...i think we can call them the backlog center when compared to Chicago which is processing it in a week or two :-))

Pankaj, the writeup is spot on except for the above. I am not sure it takes anyone in the EB category, 20 years to get the GC. It may happen in the future if retrogression is not fixed.
IMHO, it is important that we stick to facts when we write articles/op eds etc.
OK, I edited the text to make it clearer that 20-25 years applies only to some family based immigrants. Let me know if it reads OK (grammar etc.) after the edits.

My application was sent on June, 14th and delivered on June 15th (I have the FedEx tracking info and signature page confirming 6/15).
The case status online based on receipt number (obtained by calling them a few times until I got lucky) says:
"On July 11, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice describing how we will process your case."
Not sure if the online status is referring to the receipt date or the notice date when it says "On July 11, 2007, we received" when, in fact, they received it on June 15th!!

Please share your experiences if you renewed your NJ DL with EAD renewal notice.
My nj dl is due for renewal. I have applied for EAD renewal. I have the receipt notice and am working on EAD.

I assume you want to renew DL based on the receipt notice for your EAD renewal not the valid EAD itself. If so, I know the Edison DMV located on kilmer rd (near edison train st) gives you 6 mo. renewal... I got it from them in dec based on my h1 rcpt notice...
If you have a valid ead, then they'd renew your DL till the expiry shown on EAD.

I live in colorado...my H1B is going to expire Oct 27...I have not applied for H1B Extn. yet...But i have EAD...According to colorado DMV i should be able to use EAD for driving license extn...but does using EAD invalidates my H1B??...i am planning to apply for my H1B extn this week...but i won't be able to get approval in 3 weeks (assuming i do premium processing)...Please help me.

I think there are many ways to look at it. Doing Free service , yes it is a form of Gandhigiri, but will that cause the lawmakers to recognize us and pass laws in favor o fus..I do not think so.
I think our situation is no different than people in South Africa in Gandhian times. How Gandhi fought for them is by writing and writing and pestering the Authorities to reduce unfair taxes on Indians in SA and to solve other problems they had like cannot ride in the same Trains/cars as Whites etc...., fighting for their rights in a Vocal but Non Voilent - non aggressive approach.
We, in this post , have equated Gandhigiri with - divide ur attention - Go Do MBA- be occupied with something else while u are retrogressed, furthur ur career/skills,,,etc I do not think that is what Gandhigiri is about i.e. doing something for the self, but instead do it for the community. In this case IV is our community and its leaders are doing the right thing for our cause and if we continue to support that by adding members, funds we will do a fair bit of gandhigiri towards our cause.

Don't expect anything from Nebraska Service Center today. Somebody from who live few minutes away from NSC said that the parking lot at NSC is empty today. Yesterday, she saw that it was full from 7 to 12 nn but was empty in the afternoon.
What we can expect is only automatic LUDs. No overtime work for NSC. Have they used up all the FY2007 visas? They must have....if not, this fact can be used against them when we file a complain.

I have somebody in my family who is suffering from an incurable disease , thus I wan't to stay in this country till a medicine comes out. This country is known as the pioneer in the reserach of medicines . It may take 10 years for it to be in market but it may take another 25 years to be in India. Thanks for your reply. Infact I talked to the manager(Supervisor) at two DMV locations in Houston TX. First one only told me about this rule. At second place, since I insisted they showed me the rule in writing. I also expressed my frustration asking what kind of rule is this? They just washed hands saying they didn't make the rule and put the blame on texas legislature and parliament! Anyways will try your written rejection letter option.

I am very junior member on IV forums and have listened to all the experts and senior members on IV from time to time. Very solid ideas and very intelligent people! Although, I am not too familiar with the intricacies of what DOS said or what USCIS said; what I know is that there are many thousands of us who are here in a limbo for many many years. I think we have been "super- nice" to USCIS and Congress in the way we have approached them for our problems and rightly so - thats just us!
We have done our best educate them via lobbying efforts etc but wouldnt you agree that its time be a little more "assertive' now. Seriously, we dont know what the bigger picture is here. Year after Year, Month after month nothing moves with USCIS. Same old grim Visa Bulletin. I had written elsewhere that I dont even remember what my dates are anymore! Being in a western country or anywhere else in the world for 10-12 years is a long time. The culture, the enviroment and the system grows on you. Most of us left from India or elsewhere, when we were in our mid 20s . As young adults most of were explorers - soaking information, knowledge, new skills etc as we embarked on our journey to settle down in a foreign country. I think its fair to say that most of us have actually acquired our adult wisdom here. What I am getting to, is that when people talk about packing their bags and going back home - it may only be easier said than done!
I am not an expert at this but I believe we may have to come together again and we will need more visibility - maybe a six month long agressive assertive campaign - letters, flowers, rally and more all together so that we can catch congress' attention. It seems like legislation is the only way out here. Again, please pardon my inability to comprehend issues correctly, if I am wrong in saying so, but if we continue to rely on visa bulletins and USCIS; nothing is going to happen. All I can say is that whatever leaders and intellects at IV decide, I am here in anyway you all need me to help! Please feel free to ask for help at jaisinghaII@gmail.com.
