Hello,
I obtained an EAD using my OPT just to be able to work in the U.S. while my fiancee completes her degree (I graduated in December 06 and she will do so in May 07). Since we will get married after she graduates, and will file for adjustment of status, we thought there would be no problem in my ability to work without any interruption.
However, it seems that filing for adjustment of status invalidates your OPT, therefore you wouldn't be able to continue working until you get your new EAD.
Does that mean I would have to stop working for 90 days or so after I get married? (Remember I'm on an F-1 as I think you can keep working if on an H-1B)
If so, is there any way to minimize this problem?

No that's not the case, there are stringent reqmts for proof of Date of Birth. Passport is not one of them...
Please check other forums where this has been discussed..
I think a passport can be used to show the birth date.

If we lose our job after having the I-485 pending for more than 8 months, I-140 approved, how much time do we have to find another job?
Do we have to immediately withdraw the petition after losing/quiting a job?

The advice i got is that you should be in a new job ( and notified USCIS about usage of AC21 ) before,
1. The I-485 is approved
2. Any RFE directed to the old employer
I don't think one needs to withdraw application.

Folks,
We move and my wife and I did an online AR11 and ONLINE I-485 Mailing address change using USCIS website yesterday.
My wife got an automatic email confirmation that her I-485 Mailing Address is changed and we even see the LUD is changed as well
but I didnot get any email confirmation of the address change of I-485 neither I see any LUD change.
1. What should I do? Call CIS?
2. How long does it take to update Mailing Address on I-485 when changing the mailing address online after Online AR-11 submission?
Please advise

:)I was cited under open container law in state of NJ newark pennstation.will this impact on my immigration status . I am a july 2007 filer waiting for the GC and working on EAD

I have not used AP to enter so far but I do not believe AP is related to employment and questions related to that should not be asked when entering the country if one is using AP to enter. Just IMHO

I have a question regarding the H1 / H4 status of my spouse.
My spouse entered US in 2006 on H4 visa (valid till 2008 ). In 2007 she applied for H1B and the I 797 start date is October 2007. She did not apply for any status adjustment (from H4 to H1). She did apply for SSN using the EAD and presently not working.
I just wanted to know, what is her visa status now. Is it H4 or H1?

I have few questions and seeking your advise on it. Currently I have a H1B and EAD with EB3 category GC application.
1. I am working on H1B for "X" company and they have filed extension for it. Now, I got an offer from "Y" company and they are willing to transfer my H1B.
Is there any problem for H1B transfer to the Y company while it is filed for extension from my current employer?
2. The new company "Y" is also going to file my new GC labor and I-140 as job has little different and senior role but similar to what I had in my previous H1B and GC labor in EB2 category.
Now, can my current employer "X" company remove I-140 or create any kind of problem for my immigration status, specially with GC?

Hi,
My EAD got expired in July and I got the Denial Notice of the H1B petition last week. My lawyer thinks it's got rejected because of my salary change and address change. So she's going to file a new H1B petition on a nunc pro tunc basis. What is nunc pro tunc? Is my case eligible to file such a petition?
And if not, what other options do I have?
Please give me some advice, any advice you think might work. Thanks!

I have an Indian passport and currently working in USA on L1B visa. Before leaving India I initiated the process of getting permanent residence visa from Australia and while I was in USA I got the AU Independent (Migrant) Visa (Subclass 175) visa approved and it was stamped on my passport by the AU embassy in Washington DC.
My queries are:
- I am planning to go for a vacation to India very soon. While returning to USA will it be a problem with my Indian passport having both USA L1B visa and AU migrant visa.
- For the initial entry to AU, I want to go there next year only for a week directly from USA. Will it be a issue for me to enter the US in my return trip
Your advice on this will be very helpful.

I'm Australian and would like to return to the U.S. to visit in-laws with my partner but I overstayed my visa on my last visit.
On my last visit, I received a 6-month visitor visa then extended my visa another 6 months. I overstayed my visa by 11 weeks; I was helping my same-sex partner move. This was two years ago. I did not work for anyone while in the States.
What can I do if any to improve my chances of not getting turned away at Immigration?

Only spouse and unmarried children under 21 can be added as dependents on your I485 application.
If you are a US citizen then you can sponsor parents for Green card
If you are a US citizen then you can sponsor parents for Green card
