I'm going to guess that the same folks in the Tea Party screaming about the deficit will somehow find this breaking news to be irrelevant. Of course, they also think the sky's the limit when it comes to spending on immigration enforcement. So much for being consistent. I'm in France until Sunday and blogging from my iPad. My AP approvals are lost in mail, my employer mailed them in ordinary mail during holiday season (12/11/07). What can I do next? Go thru attorney for duplicates? Please advice.

I just filed for an H1B transfer in April. My current H1 is valid till April 2010. Just got an email from CRIS stating that my current I-129 case which was approved in April 2007 has been reopened at USCIS determination for review. Is there a problem or is it just normal procedure to look at the original H1B petition? Have transfered H1B before but have never had this happen. Is this something new that they are doing? Incidentally I am on the 10th year of my H1B and have a copy of the approved I-140 based on which we filed for a 3 year extension.

JUST before Congress adjourned for its August recess, Democrats engaged in a flurry of legislative activity, while Republicans complained about a �do-nothing� Congress�s meager policy accomplishments. Deep partisan differences, narrow majorities and a Republican in the White House have frustrated Democratic ambitions and fueled a toxic atmosphere in both chambers of Congress. The public�s low approval ratings reflect broad discontent with the direction of the country but also displeasure with Congress for failing to reverse course on Iraq and for continuing the bitter partisan warfare.
But has this really been a do-nothing Congress? The circumstances are similar to those in 1995, when a new Republican majority in both houses took office under a Democratic president. So perhaps the best question to ask is, how is this 110th Congress doing compared with the 104th Congress, in 1995?
Both new majorities began by spending more time in session, holding more committee meetings and roll call votes, and passing more substantive measures than the Congress before them had. At the same time, in both cases, the number of bills signed into law by the president from January to August dropped.
Still, the Democratic Congress�s legislative harvest this year has been bountiful compared with that of its Republican counterpart in 1995. Back then, the Republicans� Contract With America was stymied by opposition from the Senate and the president. The new Congress has enacted a far-reaching lobbying and ethics reform bill, an increase in the minimum wage, recommendations of the 9/11 Commission, foreign investment rules and a competitiveness package, and has embedded a number of major initiatives and new priorities in continuing and supplemental spending bills. Democrats also made headway on energy, children�s health insurance, college student loans, Head Start, drug safety and a farm bill � though much of this awaits action in the Senate or in conference and faces a possible veto.
During the first seven months of 1995, Congressional oversight of the executive branch increased modestly in the Senate but not at all in the House. But this year Congress, especially the House, has intensified its oversight, following years of inattention and deference by its Republican predecessor.
Democratic promises to restore civility and regular parliamentary procedure by allowing the minority party a larger role in deliberations have foundered. The number of restrictive rules for debate has increased, and the conference process has been short-circuited on various occasions.
In the Senate, Republicans have made the filibuster, or the threat of filibuster, routine, setting a 60-vote hurdle for all contested legislative matters. This has led Harry Reid of Nevada, the majority leader, to file many more petitions for cloture than Bob Dole, his counterpart in 1995, did.
The chart below shows what the 110th Congress accomplished before it closed for its August recess, compared with its immediate predecessor and with the Republican Congress that took office in 1995.

Friends,
I have a scheduled EAD FP (e-filed) next Monday in the Dallas Area.
My 485 FPs have not yet come and my dates are current. I am planning to ask the ASC Officer if they can take my 485 FPs also. I know some people had success with this method.
However, my situation is a little different,
I do not have my 485 Receipt (Lost in mail and returned as undeliverable :( ). I have opened numerous SRs and have those notices. What can I take to the ASC ??

I didn't have any problem at Port of Entry. The immigration officer scanned the visa, but I guess he didn't find anything linking to the fact that the previous company has canceled the H1.

Enrique's Journey (http://www.npr.org/templates/story/story.php?storyId=5225180) is a very powerful book written by an LA Times journalist about illegal migrants who take the Tren de los muertos, or the Train of the Dead to get to the US.
Will it be the kind of book, like 'Uncle Tom's Cabin' (http://en.wikipedia.org/wiki/Uncle_Tom's_Cabin) to shake the conscience of a country to generate true Immigration reform? Will it move the likes of even politicians, who have no conscience, and get Immigration Reform accomplished?
I hope so. I had tears all through while reading the excerpts from the book, and hearing Sonia Nazario on NPR today.

I'm presently on H4 in US and have got the H1B visa approval(Mostly I would get the I94 and wouldn't require stamping unless i leave USA) . Due to personal reasons I need to travel to India planning to go to India.
I would like to get the visa stamped in Tijuana before I go to India.
I have not yet started working with my employer.Infact I did not get my H1B approval papers yet nor have SSN till now.(approval of H1B is on Oct 16th 2007)
Since October has been crossed and i dont have a paystub(since my approval is late) my question is are there problem if the consulate officer asks about why i have come for stamping even before starting the job (since i have 194) and what if he asks for paystubs as iam going after october 1st.
Can anyone please help?

I am on 7th year of H1B with approved 140. 485 not filed yet.
My company is starting layoff and I am afraid I will be hit. If I switch to H4 after being laid off and found a new employer in future, is that possible to switch back to H1B without having to leave the country for a full year?
My current H1B was a three year extension based on approved 140, but I don't know if I will lose the benefit of AC21 and cannot change back to H1B once I switch to H4 since my 6 years have been used up already.

While we all sit and wait in this painful 485 retrogression, I am just wondering, what if the retrogression pulls on past the 3 year extension (attained after the initial 6 years and I140 approval).
I have my perm LC/I140 approved/485 retrogressed with a PD of Feb 2006.
Being EB2 and starting my 7/8/9 years in early 2007, I am a bit unlikely to hit that scenerio, but someone like me in EB3 is very likely to hit that scenerio...
Does anyone know, what happens after 9 years on H1 and not able to file 485 due to retrogression??

What is Image Croping? U need to understand that! The area which you will select will give you the x y co-ordinates which should be fed into the LockBit method this method will retutn a pointer. Yes the code will be unsafe but it will work i did it. Now Use the scan0 property then increment the pointer [0] for green [1] for blue [2] red and copy to any another file which will become your new croped image. I can provide you the source code snippet but why dont u try for urself first thats how people lear not by spoon feeding. Try a bit googling with search string as Simple Dialation Using C#. I have filed my 485 on July 2007. I am currently working using EAD and last time entered US in Feb 09 using AP. My current AP is valid till Oct 17 2009. I will be going out of the country for few days in early Sep. I wanted to know can I apply for my renewal of AP now. I read the following in the I-131 filing instructions (page-4)
If you travel before the advanced parole document is issued, your application will be deemed abandoned if:
1. You depart the United States; or
2. The person seeking advance parole attempts to enter the United States before a decision is made on the application
So can I apply for my AP renewal now (I am assuming if I apply now it won't get approved before my travel in Sep) or do I need to first complete my travel in Sep, come back to US and then apply for the renewal.
Please reply.

I am >35 so need medical exams done and attested by a MD Doctor. I and My agent has no clue where to get it done. Doctors here charge for those test and not sure if they would attest those papers.

My question is, it is mandatory for her to carry my original I-797 petition and I-129?? I have sent photo copies of both the documents, but I read some where that she has to carry originals of these 2 docs. can you pls clarify??
