I work full time and will continue to work with same employer in the near future, despite having switched to EAD. However, I will use AC21 if a substantially better opportunity presented itself.:)

If USCIS update says the data entry is done upto a particular date and you do not get application back in next few days, it means it is atleast accepted and now just the matter of issuing reciept. AM i right?

I believe someone already asked a similar question but I just want to describe my exact situation:
- My LC (EB3) got approved on July 2007, PD is March 2007 - Company A
- My I-140 and I-485 were filed concurrently on July 2007 - Company A
- I work as a contractor and my client (Company B) is offering me a full-time job and would like me to join on Sept 2007
- I still have 4 years on my H1B
With the assumption that my current employer (Company A) will give full cooperation on my current GC process, if I join company B on H1B transfer now, can I possibly invoke AC21 later after my I-140 gets approved and I-485 is pending for more than 180 days?
I'll greatly appreciate any comments.

2 (a) is only if you have an approved I-140. In your case write "Concurrent filing of I-140/I-485 based on NIW"

Good MOrning All I have 2 questions:
1.) My littel sister is living with a Looser for the past 10 teays and he refuse to file for her Residency. So got pregnat last year and now has a baby by him. Is there anything she can do to get her residency in this situation?
2.) I am married to a US citizen. I have a Pending case with USCIS however it has been draging out for too long. I wanted to file for my Residency using my Current marriage. She is a US citizen however dose anyone know if there is a limit or time frame when a US citizen can file for someone else? She was married before and filed for her X-husband residency. Can she file me now without any problem?

So this may be the last week of H1B visa filings, as of November 27, 2009, approximately 58,900 H-1B cap-subject petitions had been filed. USCIS has approved sufficient H-1B petitions for aliens with advanced degrees to meet the exemption of 20,000 from the fiscal year 2010 cap. Any H-1B petitions filed on behalf of an alien with an advanced degree will now count toward the general H-1B cap of 65,000. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.

Hi ,
I have been residing in the U.S. (NY) since 0ct 2007 with an H4 visa. My dad had and still has an H1B visa. I have completed my high school here in the States only and now I am enrolled as a full time student in a college (in-state tuition). Now the problem is I will turn 21 this February and I believe I will no longer be a dependent on my father's H1 visa and would be residing "illegally". In that case what should I do? I want to complete my studies and stay here in the U.S. with my family and not be deported back to my home country all alone :(
Is changing to F1 a good option for me ? I heard it could be risky? Is there any way I could have my studies going smoothly as it is now considering the out state tution under F1 would be too much...
any suggestions and help would be greatly apppreciated

Hello Everyone,
My wife is trying to process visitor Visa for her parents and she has a problem with her mothers name in the Passport as it reads just the short name instead of her Full name.
I'm wondering if the Affidavit would be sufficient while going for Visa or would this still be a problem?
If affidavit is sufficient, can someone please kindly share the sample affidavit if you have one?
