Nothing unusual...infact just a tiny tip of an iceberg. Family based immigration including marriage constitute close to 85-90% of US new immigrants. Other avenues being tightened in recent years, we are sure to see more and more. In fact in recent years I have seen many H1Bs/F1 marrying USC.
For every case being busted, there are many many undetected cases. It is called legal arbitrage, with other areas being tightened amd under attack and marriage based being relatively untouched, it is a matter of time that one will increase.

Can this event set a precedent for Western Immigration programs to treat people fairly ?
A similar thing had happened in the past when Canadian Immigration Agency increased the eligibility pass mark. Six months later a court ruled that they have to accomodate those who are already in the system.
I wonder if this open a judicial precedent for unjust affect of 245(i) on all of us. Interesting enough, UK skilled immigrants also have something similar to immigration voice.

He is my attorney for my GC process. He had successfully done my PERM application last year and now we are processing I-140 from last 4 months. Best thing is that he is quick and his paralegal call/email you whenever they miss any document instead of waiting for long time and going thru employer channel which consumes lots of time in between.

My situation is: last entry to US with F1 visa as a student. After graduated, got H1 visa, but didn�t leave US during the period.
When filling I485, need to answer the following questions.
1. In what status did you last enter?
For my case, should I fill �F1� here.
2. Nonimmigrant Visa Number, Consulate where visa was issued and issue date?
Does this refer to my H1 visa number? If so, since it is not issued by consulate, how I can answer the last two questions?

I asked my attorney if we could anything about the delay in the issuance of EAD. My attorney mentioned that she would send an e-mail to USCIS. Is there an e-mail id that attorneys use to contact USCIS ? Offcourse, I could have asked my attorney, but I thought I would post the question here first.

Arizona's reputation for right wing lunacy certainly will be enhanced by this effort. Or maybe there's some pretty rational thinking behind SB1070 and eliminating rights for American born citizens of Hispanic descent. 30% of Arizonans are Hispanic. 42% of all students from kindergarten through twelth grade are Hispanic and the percentage goes even higher for the younger grades. The Senator Chuck Schumer (D-NY), the Immigration Subcommittee Chairman, told the AP yesterday that he plans on introducing a comprehensive immigration reform bill before Labor Day and then hopes to have a debate on the bill in the fall. Schumer hinted that advocates for highly skilled immigrants are likely to be happier with the bill than those pushing for guest worker reforms for lesser skilled workers and that business and the unions have yet to reach a compromise. I would apply for the renewal EAD now. Are you using the EAD to work ? Normally if the EAD is not approved after 90 day wait, then one can get a temp EAD form the local office. Give yourself some time, just in case something gets dealyed.

You may be able to stay without a job as long as the future job offer is still open and the gc sponsoring employer has an intent to hire you after the 485 is approved. Please confirm with your immig attny
