Call me insanely confused idiot, but here is a thing:
I work for a major MNC (of course pays me 15% less than I should be making). My boss is also leaving the company. At the same time, I am getting an offer from another local (small) company, better position and pay. My GC is pending PD Jul-05/EB2 India from MNC. Should I leave at the 11th hour?
Just to clarify both are consulting companies.

Hi,
I need some advice on what are my options.
I have been working with a consulting company since June 2006. I have an approved Perm and approved 140 with the same company.
Before my Perm and 140 were approved we got my H1-b extended till September 2011.
I am planning to visit my home country and need to attend for Visa stamping. I have booked my tickets too.
The problem is my company has recently changed its location and I have the old address on my paperwork (I-797, LCA etc)
But the latest pay stubs have the new Address.
Will I have any problems when I attend for Visa stamping?
Do we need to apply for the ammendment? In that case should I postpone my trip, get the paperwork and then go for stamping?

I94 expired on 2/12 and my H1b extension was filed on 2/24.
Both my EAD and AP are expired (getting them renewed now).
My 485 is pending status (PD is May 17th 2006).
My lawyer says he requested USCIS to use discretion to grant H1B extension (with extension of stay) even though its filed late. If USCIS does not agree, I need to leave the country to get visa stamped (for H1b) in which case my pending 485 application can get affected.
For that reason he doesnt recommend going that route if USCIS doesn't approve my H1B with extension of stay. He recommends to use my EAD to continue my work. My EAD is expired as well. Can I continue to work in this case (EAD pending renewal and H1b approved without extention of stay)?

After the visa approval and before the stamping, my employer has asked me to go and work with a different client in the NY area (as my original client project got canceled). So, the client and the location are changing.
So, I will be going for my H1B visa stamping with a client letter and location different from what is in the petition. Is that OK or is it a sure shot denial case?
Do I need a new LCA or H1B amendment? My employer is not keen on doing them, and thinks that it should not be risky to go with the existing paper work.
Please give me some advise.

Status as of now : Applied as dependent (secondary) on my spouse 485 and have EAD and AP since July 2007.
2. My spouse : Primary applicant - EB3 (India), December 2003.
As the dates are NOT moving forward for EB3 (India), I want to port our GC application dates from my spouse priority ( EB3- India - December 2003) to mine (EB2 - India - September 2006)
My question is, Can I change my status from dependent (secondary ) on my spouse 485 to me being primary applicant by invoking my approved I-140 (EB2 - India - September 2006), If YES what would be the process.

Hello folks. I hope someone can help me out on this issue. I applied for my wife's EAD back in July 2007. The EAD was processed in two weeks and we received the card. However, my wife's middle initial was incorrect and we sent it back to USCIS with an explaination concerning the mistake. USCIS stated that it would take anywhere from 2 months to 6 months to process the correction. Last week I received a letter from USICS stating that I need to submit a completed I-90 form. A I-90 form is used to replace a green card. We just applied for our adjustment of status in 6/2007 and are not permanent residents at this point. Getting the EAD has become a nightmare for us. Do I try and write a letter back to USCIS stating that they are asking for the wrong form. I tried to call them but they said to respond to the letter sent. I'm stuck between a rock and a hard place. Any help/advice would be appreciated.

You should be able to contiue your GC without interruption even if you did not work for the sponsoring employer. but just make sure you are employed with the sponsoring employer before filing for I-485.
You may need a new H1 to go back to the previous employer. But GC should not be affected.

What is the best way to save one from going out of status on E-3 visa?Can a E-3 Visa holder or E-3D visa holder may apply and successfully get EB-3 or EB-2 green card?Can E-3 visa holder may work for two employers (already USCIS approved extension petition from both) simultaneously (without filling any new I-129 or extension request)?
The place of birth for E-3 Visa holder is Pakistan.
Please suggest and advise?

I have the following questions with respect to number of days I can stay out of the country for my situation.
I have been on green card since June 2010.
I have visited India from October 17' 2010 to Feb 4' 2011 (Total 111 Days).
Now I need to go back to India again for around 3 months (Approx 10th May - 10th Aug) which is about 93 Days.
My questions are:
1. As a GC holder can I make the above visits without resetting my 'Continuity of 5 Yeard of Residence' clock ? As in each calender year I will not be out of country for greater than 180 days. But, when you count from October 16 2010 - October 15 2011, I will be more than 180 days out of the country.
2. If answer to the above question is NO, do I need to file/apply for any exception to be out of country?
